Terms of Service

1. Definitions

• Service or Package: The Cloudflare Escape Package, including a tailored migration plan ("Deliverable"), a 90-minute strategy call, and one month of Telegram support.
• Deliverable: A PDF migration plan, call recording, and related checklist.
• Questionnaire: The intake form you must fully complete (Cloudflare zone export, API token, bandwidth, etc.).
• Payment Processor: Stripe or BTCPay Server.

2. Scope of Service

2.1 What We Do

• Analyze your Cloudflare configuration and provide a written migration blueprint with cost-and-risk breakdowns.
• Conduct one 90-minute live strategy call (recording included).
• Offer Telegram-based advisory support on a case-by-case basis, with replies in ≤ 12 hours.

2.2 What We Don't Do

• We do not execute migrations, host or proxy your infrastructure, or manage your origin environment.
• We do not guarantee any specific cost savings, performance improvements, or uninterrupted service post-migration.

3. Client Obligations

3.1 Questionnaire

• You must submit the fully completed Questionnaire before we begin work.
• The 72-hour delivery SLA (Section 4) starts only after we receive your complete Questionnaire.

3.2 Scheduling

• You must schedule your 90-minute strategy call within 30 days of receiving the Deliverable.
• Failure to schedule or attend the call within 30 days forfeits your right to that call.

3.3 Telegram Support

• Support is advisory and provided on a case-by-case basis.
• We strive to reply within 12 hours of each request.
• We may decline requests that fall outside our scope (e.g. live migrations, custom code debugging).

4. Delivery & SLA

• We will email your Deliverable within 72 hours of receiving your complete Questionnaire.
• If you fail to provide required data, the SLA clock pauses until you do.

5. Payment Terms

• Fee: US €1897, due up-front at checkout via Stripe or BTCPay.
• Price Changes: Rates may rise as we validate demand; the price displayed at checkout is final for your purchase.
• Taxes: You are responsible for any sales tax, VAT, or other governmental charges.

6. Refund & Cancellation

• 48-Hour No-Questions-Asked Refund: You may request a full refund within 48 hours of purchase, for any reason, no questions asked.
• No Other Refunds: After 48 hours, or once the Deliverable is provided, no refunds will be granted under any circumstances.

7. Disclaimers & No Guarantees

• All information and Deliverables are provided "as-is" without warranty of any kind.
• We do not guarantee that you will save money, improve performance, or avoid future Cloudflare charges.
• The ROI calculator on our Site is an estimate only (≈ 70 % accurate) and not legally binding.
• We are not affiliated with or endorsed by Cloudflare, Inc.

8. Intellectual Property

• All methodologies, templates, and scripts remain our exclusive property.
• You receive a non-exclusive, perpetual license to use the Deliverable for your own internal business purposes.
• Redistribution, resale, or publication of our materials is strictly prohibited.

9. Confidentiality

We will treat all information you submit (zone exports, API tokens, etc.) as confidential and will not disclose it to third parties, except as required by law or to our service providers (Stripe).

10. Limitation of Liability

• Our total liability to you for any claim under these Terms is capped at the amount you paid (US €1897).
• We are not liable for any indirect, incidental, special, or consequential damages, including lost profits or business interruption.

11. Indemnification

You agree to indemnify and hold harmless Ditchflare and its affiliates, officers, and employees from any claims, damages, or expenses arising from:

• Your use or implementation of the Deliverable;
• Your breach of these Terms;
• Any third-party claims related to your use of Cloudflare or alternative providers.

12. Force Majeure

Neither party is liable for delays or failures in performance due to events beyond their reasonable control, including natural disasters, acts of war, or network outages.

13. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Slovenia. Any dispute will be resolved exclusively in the competent courts of Ljubljana, Slovenia.

14. Changes to Terms

We may update these Terms at any time. Updated Terms will be posted at https://ditchflare.com/terms. Continued use after changes constitutes acceptance.
